Criminal Defense Attorney in Phoenix

Do you need a criminal defense attorney in Phoenix?

If a prosecutor has charged you with domestic violence, felony assault or another type of criminal offense, then you may have feelings of helplessness and uncertainty swirling around inside of you.

Uncertain of where to turn to and who to trust, you need a trusted source to guide you through the criminal court system who genuinely is out to protect your freedom.

As a staunch advocate for defending people accused of a DUI in Phoenix, AZ and the surrounding communities, I also support those charged with a range of criminal offenses.

From sexual assault to white-collar crimes, you will never get fed a line of bull from me, just straightforward truth dependent on the circumstances of your case, possible defenses and potential outcomes.

As a Phoenix criminal defense attorney, I handle the following types of criminal cases:
In each case that I defend, no matter what charges my client is facing, the goal is always to get the state to dismiss their case long before the trial or to negotiate a plea agreement that benefits the person who made a mistake.

Depending on the offense, you could be facing either a misdemeanor or a felony charge. A Class 1 misdemeanor is the most serious of the misdemeanor offenses and is punishable by up to 6 months in jail and 3 years of probation.

Depending on the offense, felony convictions can result in between 2-25 years in prison, so it is important to consult with an experienced criminal defense attorney early in the process.

Experience in the Courtroom Matters!

Since 2006, I have built my career defending clients accused of serious criminal offenses.

Before entering into private practice, I began my legal career as a public defender representing people who did not have the resources to retain a lawyer. I then went on to work for one of the largest law firms in Phoenix, defending hundreds of people facing serious criminal charges.

Assertive in the courtroom and when questioning my clients, I may not appear like the most empathetic person you have ever met. However, when facing serious penalties like jail time and costly fines, the situation cannot and should not be taken lightly.

Regardless of how you perceive my bedside manner, you can rest assured that my passion for defending my clients runs deep.

I grew up in a family of criminal defense attorneys. More than just following in my family’s footsteps, I believe that defending those charged with a crime is an opportunity to protect their constitutional rights afforded to them by the United States Constitution.

My motivation for defending my clients is as follows:
  • To uphold the U.S. Constitution and to use the Constitution to protect my clients

  • To protect the accused from the excesses of law enforcement and overzealous prosecutors

  • Because it is truly satisfying to help those in trouble
As a Phoenix criminal defense lawyer, I have successfully defended clients in numerous cases to a jury and judge. Respectively, over 55 jury trials and over 120 bench trials.

To take advantage of my passionate and dynamic legal services, contact me today at 480-729-1683 to schedule a free confidential consultation. I look forward to meeting with you, answering your questions and providing you with an aggressive criminal defense.

Criminal Defense Lawyer Frequently Asked Questions

When Should I Hire a Criminal Defense Attorney?

Were you arrested for allegedly committing a crime? Whether you receive a misdemeanor or felony charge, you need criminal defense representation as quickly as possible. If possible, you should hire a criminal defense attorney before speaking to the prosecution or answering questions from the police or investigators.

However, you may not have the opportunity to find an experienced criminal defense attorney until after you are released from police custody. The sooner you have an attorney in your corner, the better your chances are of avoiding a costly conviction. Your attorney will need time to thoroughly review your case and uncover the truth of what actually happened.

As a defense lawyer, I have many years of experience representing criminal defendants and will do everything I can to influence the outcome of your case. It is imperative that you contact me as quickly as possible after your arrest or after receiving a criminal summons. Give me a call today at 480-729-1683 or send me a message to schedule a free case evaluation. I will provide you with aggressive and compassionate legal representation and immediately begin preparing your criminal defense.

How Much Does it Cost to Hire a Top Criminal Defense Attorney in Phoenix?

The cost to hire a top criminal defense attorney in Phoenix will depend on which law firm you contact for legal representation. Each lawyer you interview will likely quote you a different price for his or her services.

It is important to remember that the price you pay for legal representation may not reflect the quality of legal services you receive. Many large firms in Phoenix have higher hourly billing rates than smaller firms and solo practitioners.

Attorneys from a smaller firm may have more time, energy and resources to devote to your case. They could provide you with more personalized care and have a lot more flexibility in their hours and availability.

When choosing a criminal defense attorney in Phoenix, you should interview each candidate and see whether their work style and legal approach suit your needs.

At the Law Office of Aaron Black, there are many factors we consider when determining how much to charge for our legal services. The facts of your case, the classification of your criminal offense and the number of counts or charges you face all factor into the price we charge our clients. You can rest assured knowing that I have a reputation for offering competitive prices for DUI and criminal defense cases.

While finances may be an issue when hiring an attorney, it is important to remember the price you pay upfront will pale in comparison to the price you pay if you receive a criminal conviction. You will save a lot of money and stress over time if you have an experienced defense attorney handling your criminal defense.

What Are My Rights When I Am Arrested in Arizona?

The majority of people have no idea what their rights are after the police place them under arrest. While we rely on law enforcement to protect us and keep us safe, we are entitled to certain rights when arrested or pulled over. First, the arresting officer must read a suspect his or her Miranda Rights. Before questioning you, the law enforcement officer must tell you the following:
  • You have the right to remain silent

  • Anything you say can be used against you

  • You have a right to have a lawyer present during questioning

  • If you cannot afford a lawyer, then you can have one appointed for you
If you are not read your Miranda Rights, then a Phoenix criminal defense lawyer can file a motion to suppress any statements you made to the police after your arrest. Never volunteer any information before being questioned by the police. If you do so, then the court could determine that your statements are admissible.

In addition to informing you of your Miranda Rights, you also have other rights that the arresting officer must respect. A police officer cannot require or force you to talk, answer questions or sign any documents. If he or she forces, coerces or intimidates you into revealing incriminating information, then you could have this evidence thrown out of court.

After the arresting officer takes you into custody, you have the right to communicate with a lawyer after a reasonable amount of time. You also have the right to be booked within a reasonable time frame. These are only some of the rights you have when arrested in Arizona. I can offer you a full explanation of your rights after an arrest and make sure that the police do not abuse their legal authority.

What Happens if I am Charged With a Misdemeanor?

If you receive a misdemeanor charge in Arizona, then it is essential for you to contact a Phoenix criminal defense attorney as soon as possible. He or she will attend your court appearances, negotiate with the prosecution, conduct a thorough analysis of your case and gather important evidence on your behalf. In most cases, the misdemeanor court process takes between 3-6 months to complete. However, every case is unique and could last longer or shorter than the average time frame.

I will advise you throughout each step of the legal process. A typical misdemeanor court case will go through the following stages:
  • Initial Appearance

  • Arraignment

  • Pre-Trial Conference

  • Trial Readiness Conference

  • Pre-Trial Evidentiary Motions and Hearings

  • Trial
Depending on the severity of your misdemeanor offense, a conviction could result in a range of collateral consequences, including but not limited to jail time, probation and thousands of dollars in fines. An experienced criminal defense attorney like myself can take proactive measures to mitigate or avoid a criminal conviction. Reach out to me today for help with your Arizona misdemeanor case.

What Factors Influence Felony Sentencing in Arizona?

There are several factors that influence felony sentencing in Arizona. First, Arizona crimes are typically grouped into two categories: dangerous crimes and non-dangerous crimes. If your criminal offense is labeled dangerous, then this would increase the sentencing range for your particular crime.

Second, Arizona uses determinate sentencing for felony cases. A determinate sentence has a defined length that cannot be changed by a parole board or other agency. For each class of felony, there is a maximum and minimum sentence, along with a presumptive sentence in between that range.  Most judges will start with the presumptive sentence when determining a person’s sentence.

There is a variety of mitigating factors that could reduce a sentence to the minimum or mitigated sentence. There is also a variety of aggravating factors that could increase a sentence to the maximum or aggravated sentence. An example of a mitigating factor would be the age of the defendant or whether he or she was under duress when committing the crime. An example of an aggravating factor would be whether the defendant committed a violent crime or whether he or she attempted to receive a financial benefit from the crime.

As an attorney experienced with felony criminal cases, I can attempt to limit your felony sentencing by challenging the state’s evidence in court. Depending on the evidence I uncovered, you could even have your case dismissed entirely. Contact the Law Office of Aaron Black today for experienced and aggressive criminal defense representation in Phoenix Arizona and the surrounding areas.

Can I Get Out on Bail Until My Trial Date?

Like many things, being released on bail until your trial date depends on the severity of the crime you have allegedly committed and your previous criminal history. If you have a record of criminal activity, then a judge is less likely to release you on bail than a first-time offender.

It is also important to remember that your bail conditions will differ depending on the facts of your case. If the police arrest you for committing a drug crime, then your bail conditions could include you refraining from drug use and from being in contact with other drug users. If you violate your bail conditions, then you could end up in jail until the completion of your trial.

At the Law Office of Aaron Black, our law firm can help you obtain bond conditions that are fair and reasonable to the defendant. I will do everything I can to secure you a favorable release based on the facts of your case.

Should I Get a Public Defender for Free?

Public defenders are some of the best lawyers that know the courts extremely well. At the beginning of my career, I worked as a public defender and benefited from the same training. However, public defenders are well-known for being overworked, and you may not receive the personalized attention your case deserves. They have too many clients and not enough time to mount a rigorous defense.

When you hire me, you get years of legal experience defending both felony and misdemeanor charges. Perhaps most importantly, you will receive personal legal representation, not a paralegal or a junior lawyer working on the bulk of your case.

Why Do I Choose to Defend Criminals?

People often ask me why I want to defend criminals. Not a strange question considering the violence, degradation and decay of civility in society today. Nor is it a surprise considering the intolerant attitudes held by many toward those accused of crimes, in many ways primed by crime news and true-crime television shows.

Making sure that my clients get a fair trial is my mission, and I would not have it any other way. Everyone deserves a strong legal defense, especially defendants accused of committing a federal crime or federal offense. Someone must step in and make sure their constitutional rights are protected from overzealous federal prosecutors looking to beef up their case records.
